Terms of Service

These Terms of Service govern your use of InspectAI. The most important thing to understand: InspectAI is a productivity and drafting tool — it does not perform inspections, and it does not replace your professional judgment or your licensing obligations. Please read Section 4 carefully.

1. Acceptance of terms

By creating an account or using InspectAI in any way, you agree to be bound by these Terms of Service and our Privacy Policy. If you are using InspectAI on behalf of a company or organization, you represent that you have authority to bind that entity to these terms, and "you" includes both you personally and that entity.

InspectAI is operated by Steps Ventures LLC, a Delaware limited liability company ("InspectAI," "we," "us," "our").

2. Account and eligibility

You must be at least 18 years old to use InspectAI. You represent that:

We may suspend or terminate accounts that we believe have been compromised, are being used fraudulently, or are violating these terms.

3. What InspectAI is

InspectAI is software that helps licensed inspectors document observations in the field (audio, photos, spatial notes) and drafts narrative inspection reports from those inputs using artificial intelligence.

InspectAI is not:

Reports generated by InspectAI are AI-assisted drafts based on data you capture in the field. They are not automatically professional reports until reviewed, edited, and approved by a licensed inspector.

4. Professional responsibility

This section governs your core obligations as an inspector using InspectAI. Read it carefully.

4.1 You are the inspector

Every report you deliver to a client using InspectAI is your professional work product. InspectAI generates a draft; you are responsible for reviewing, correcting, and approving the final report before delivery. By delivering a report to a client, you represent that you have reviewed it, that it reflects your independent professional assessment, and that it meets all applicable standards for your license type and jurisdiction.

4.2 Licensing requirements

Home and property inspectors are licensed in most US states and many other jurisdictions. By using InspectAI, you represent that you hold all licenses, certifications, and permits required to perform inspections and deliver inspection reports in every jurisdiction where you practice. InspectAI does not verify licensing and takes no responsibility for your compliance with licensing law.

4.3 AI output is not a professional opinion

InspectAI's AI-generated narrative, defect identifications, severity assessments, and cost estimates are suggestions based on pattern recognition and probabilistic models. They may be wrong, incomplete, or inapplicable to specific conditions at a specific property. AI output:

4.4 Client disclosure

We recommend (and some state regulations may require) that you disclose to your clients that you use AI-assisted software tools in your report preparation. You are responsible for complying with any such disclosure requirements in your jurisdiction.

4.5 Errors and omissions insurance

You are solely responsible for maintaining errors and omissions (E&O) insurance appropriate for your inspection practice. InspectAI is not liable for claims arising from deficiencies in your inspection reports, regardless of whether AI-generated content contributed to those deficiencies.

5. AI limitations and no accuracy warranty

InspectAI makes no warranty that AI-generated content is accurate, complete, or fit for any particular purpose. The AI models we use — including Google Gemini — are general-purpose large language models that do not have the judgment, experience, or physical presence of a licensed inspector.

You assume all professional and legal risk associated with reports you deliver. InspectAI provides the software; you provide the professional judgment.

6. Your data

You own the inspection data you create using InspectAI — your photos, audio recordings, findings, notes, and generated reports. You grant us a limited license to store and process that data solely to provide the service to you.

We will not sell your inspection data. We will not use your inspection data to train AI models beyond processing individual requests through third-party APIs (as described in the Privacy Policy). We will not share your data with other inspectors or third parties except as described in the Privacy Policy.

You are responsible for ensuring you have the right to upload and process the data you submit to InspectAI, including any photos, audio, or personal information about property owners, occupants, or clients.

We may suspend or terminate accounts that violate these policies without prior notice.

8. Subscriptions and billing

8.1 Plans and payment

InspectAI offers free and paid subscription tiers as described on the Pricing page. Paid subscriptions are billed monthly or annually in advance. By subscribing, you authorize us to charge your payment method on a recurring basis.

8.2 Cancellation

You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of the current billing period. We do not provide prorated refunds for unused time in a paid period unless required by law.

8.3 Refunds

We offer a 14-day refund for new paid subscriptions if you are unsatisfied. After 14 days, subscription fees are non-refundable except where required by applicable law. Refund requests should be sent to billing@inspectai.app.

8.4 Price changes

We may change subscription pricing with 30 days' notice by email. If you do not cancel before the price change takes effect, your continued use constitutes acceptance of the new price.

8.5 Taxes

Prices are exclusive of taxes. You are responsible for any applicable sales tax, VAT, or similar taxes based on your location.

9. Intellectual property

InspectAI, including its source code, design, UI, system prompts, templates, and proprietary algorithms, is owned by Steps Ventures LLC and protected by copyright, trade secret, and other intellectual property law. You receive a limited, non-exclusive, non-transferable license to use the service while your account is active.

You retain ownership of your inspection data and reports. By using InspectAI, you grant us a limited license to process and store your data as necessary to provide the service.

"InspectAI" and related marks are trademarks of Steps Ventures LLC. You may not use our trademarks in a way that suggests affiliation or endorsement without written permission.

10. Indemnification

You agree to defend, indemnify, and hold harmless Steps Ventures LLC and its officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorney's fees) arising out of or related to:

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, INSPECTAI AND STEPS VENTURES LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOSS OF DATA, OR DAMAGE TO REPUTATION, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE INSPECTAI, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM OR (B) ONE HUNDRED DOLLARS ($100).

Some jurisdictions do not allow limitation of certain warranties or damages. In those jurisdictions, our liability is limited to the greatest extent permitted by law.

INSPECTAI IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, OR NON-INFRINGEMENT.

12. Disputes and governing law

12.1 Governing law

These terms are governed by the laws of the State of New York, without regard to conflict of law principles.

12.2 Informal resolution

Before initiating any formal dispute process, you agree to contact us at legal@inspectai.app and give us 30 days to attempt to resolve the dispute informally.

12.3 Arbitration

Any dispute that cannot be resolved informally shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules. Arbitration will be conducted in New York, New York, or via video conference. The arbitrator's decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.

You waive any right to participate in a class action lawsuit or class-wide arbitration against InspectAI.

12.4 Exception

Either party may seek injunctive or other equitable relief in a court of competent jurisdiction to prevent irreparable harm.

13. Changes to these terms

We may update these terms as the service evolves. If we make material changes, we will notify you by email at least 14 days before the change takes effect. Continued use of InspectAI after the effective date constitutes acceptance of the revised terms.

If you disagree with a material change, your remedy is to stop using InspectAI and, if you are on a paid plan, request a prorated refund for the unused portion of your prepaid term.
